Understanding Family-Based Immigration


Family-based immigration is a type of immigration system that allows certain family members of U.S. citizens or permanent residents (Green Card holders) to apply for permanent residency or citizenship in the United States. This type of immigration is based on the U.S citizen or Green Card holder’s relationship with their relative and not on skills or education level. Under this system, a U.S citizen or Green Card holder can petition for certain immediate relatives such as spouses, children under 21 years old (who also have unmarried siblings under age 21), and unmarried children over age 21 to receive legal permanent residence in the United States. Additionally, citizens or Green Card holders may petition for other relatives such as married sons and daughters, brothers and sisters, parents, adult sons and daughters (over age 21). 

 

Who Can Apply?


Any citizen or Green Card holder who has an immediate relative who meets one of the above criteria can petition for them to receive legal permanent residence in the United States. Parents of an underage child can also petition for them to receive legal permanent residence if they meet one of the above criteria. The only exception is if the parent does not have legal status themselves – then they cannot file a petition for their underage child until they have become a lawful resident themselves through another means (such as marriage).  It is important to remember that each individual case must be examined separately by an experienced attorney in order to determine whether someone is eligible for family-based immigration benefits.
